Terms of service

Software that produces publish-ready content from material you supply, and — where you have connected accounts and approved the content — publishes it to those accounts on a schedule you set. We provide software. We do not provide fundraising, marketing, legal, or tax advice.

Everything you upload remains yours. Everything the service produces from it is yours, and stays yours if you cancel. You grant us only the licence needed to run the service: to store, process, and — at your direction — publish that material to the accounts you connected. That licence ends when you delete the material or close the account.

We own Fructus Donum itself: the software, the models and prompts, the trademarks, and the design. Nothing here transfers any of that.

• The truth of what you upload. We write only from your material, so the accuracy of your material determines the accuracy of the output.
• Consent for every person. You must hold valid consent for anyone identifiable in what you upload, and record it accurately in the service. The system enforces what you record; it cannot verify that a consent exists in the world.
• The rights to your material. Music, footage, images, and quotations you upload must be yours to use.
• Approving what publishes. Content is queued for your approval by default. If you enable autopilot, you accept responsibility for what publishes under it.
• Your connected accounts. You must comply with YouTube's and Instagram's own terms. Their rules govern your channel, not us.

• Fabricate. Do not upload invented beneficiaries, statistics, outcomes, or quotations presented as real.
• Impersonate. Do not use the service to produce content that presents itself as another organization or person.
• Campaign. The service may not be used for political or electoral persuasion content.
• Harm. No harassment, no content that exploits the dignity of the people you serve, no unlawful material.
• Resell or reverse engineer. Not without a written licence from us.

We may suspend an account that breaks these rules. Where the breach is serious — the fabrication and impersonation rules especially — we may do so immediately, and will explain why.

• Monthly or annual, in advance. Charged through Stripe. Annual plans are billed for twelve months at signup.
• Usage is metered by published pieces. Reaching your plan's limit pauses generation until the next period or until you upgrade. It never produces a surprise charge.
• Cancel any time, from the dashboard. Access continues to the end of the period you paid for.
• No refunds. All charges are final and non-refundable. We do not refund partial periods, unused pieces, or an annual term you cancel early. This is why every plan begins free and no plan asks for a card at signup — you publish on Sower and see exactly what the product does before any money changes hands.
• Price changes. Thirty days' notice by email. Existing annual terms are honoured to their end.
• Verified nonprofit rates. Granted on proof of status. Misrepresenting status ends the discount and may end the account.

We aim for continuous availability and monitor the service around the clock, but we do not guarantee uninterrupted operation. Platform APIs we depend on can change, throttle, or fail, and publishing depends on them. If an outage of ours materially prevents you from using the service for an extended period, contact us and we will credit the account.

We make no representation about donations, growth, engagement, or any financial result. Content performance depends on your organization, your audience, your offer, and platform policies outside anyone's control. Anyone who guarantees you a return on content is selling something else.

The service is provided "as is" to the fullest extent the law permits, without warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the extent the law allows, Pixel Shadow LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost revenue, donations, data, or goodwill. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

Some jurisdictions do not allow these limits, in which case they apply only as far as they lawfully can.

Every charge is final. We do not issue refunds for partial months, unused pieces, or the remainder of an annual term. Cancelling stops the next charge; it does not return the last one. Your access continues to the end of the period you already paid for.

We are comfortable being this strict for one reason: nobody has to pay us to find out whether this works. The Sower plan is free, does not expire, and asks for no card. You can publish real pieces to your own channels and watch the grounding rule hold on your own words before you spend anything. A policy this firm would be unreasonable without that; with it, it is simply the deal.

Two narrow exceptions, because the law requires them and because we would rather write them down than argue about them: where a refund is mandated by applicable consumer law, and where we charged you in error — a duplicate charge, a charge after a confirmed cancellation, or a charge for a plan you never selected. Write to billing@fructusdonum.com and we will correct our own mistakes promptly.

Disputing a charge with your bank instead of contacting us suspends the account while the dispute is open. If you have a problem, email us — it is faster, and it works.

You may cancel at any time from the dashboard, and cancellation takes effect at the end of the period you have paid for — no refund is issued for the remainder. Your account reverts to the free Sower plan rather than being closed, so nothing you published disappears. We may end an account for a serious or repeated breach, or for non-payment after notice. On termination you can export everything for 30 days; after that it is deleted within 60 days.

We will email account holders before any material change to these terms takes effect. They are governed by the laws of the State of California, and disputes are heard in the state or federal courts of Los Angeles County, California.
